Who we are

Smash or Pass is run by Vertigo (“we”). You can reach us at contact@smashorpass.party. By using the site you agree to these terms.

Who can use the site

You must be at least 16 years old. If you are younger, do not use the site or make lists. Lists that are marked mature are switched off for now.

Making lists

You do not need an account. When you make a list, your browser gets a secret edit key. Anyone who has the key or the private edit link can change or delete the list, so keep it safe. We cannot recover a lost key. You are responsible for what you upload.

You promise that you made the content or have the right to use it, and you give us permission to store it and show it on the site for as long as the list exists. You keep your rights.

What you may not upload

• Photos or likenesses of real people, especially private individuals. Fictional characters, cartoons, objects, food, places and memes are fine.
• Sexually explicit content, and nudity of any kind.
• Any sexual or suggestive content involving characters who are under 18 or look underage.
• Content that is violent or graphic, promotes self-harm, or is hateful or harassing.
• Content you do not have the right to use. This includes copyright and trademark material that belongs to someone else, and you must not copy other people's lists to pass them off as yours.
• Anything illegal, and spam, scams or attempts to break or overload the site.

Images are sent to an automatic checker when you upload them and may be refused. We may hide or remove content or lists that break these terms, or that we are told about and believe are illegal, with or without warning. When we remove a list we keep a short note with the reason for 30 days, which the creator can read with their edit key.

Reporting and appeals

Anyone can report a list with the report button. Several reports hide a list until we have looked at it. To tell us about illegal content, use the notice form. If we removed your list and you disagree, write to us and give the link to your list. We will look at it again.

Deletion of old lists

Lists are deleted automatically when nobody uses them: drafts 30 days after the last edit, and published lists 90 days after the last visit. You can delete your own list at any time.

No guarantees

The site is free and provided as it is. Crowd results are what other visitors chose and are not a poll or a fact. We may change or stop the site. To the extent the law allows, we are not liable for lost lists or for what other users upload. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract, or liability that cannot be excluded by law.

Law and changes

These terms are governed by the law of France, without removing the protection that the mandatory rules of the country where you live give you. We may update these terms. The date at the top shows the latest version, and using the site after a change means you accept it.
